Eric,
I’m not sure this is the slam dunk you seem to think it is. Given Buchanan’s history, he’s not the right guy to have brought this up, but it does seem strange that there will be no Protestants on the court. If you can justify seeking diversity by naming female, Jewish, black, Catholic, and Hispanic justices, the logic ought to work in reverse.
But given Bush v Gore, any nominee with intellectual honesty will be a vast improvement, regardless of whether they’re Bahai or not.

Mitch – I didn’t know that, but I’ve never been a fan of quota-based affirmative action anyway for minorities. I’m certainly not going to support it for Protestants.

Eric,
I understand opposition to quota-based affirmative action. But come on, would you really assert that the selected nominee for each open position on the Supreme Court is the best qualified for the job? Or even that there is such a thing as the single best-qualified person for that job?
